Four Business Associations Request Amendments on the Law on Foreigners

Representatives of Montenegrin Foreign Investors Council, Montenegrin Employers’ Federation , Montenegro Business Alliance and AmCham Montenegro have signed a joint position document, in order to emphasize the necessity of amending the current Law on Foreigners.

The Law on Foreigners, which is in force since April 1, 2015, introduced additional difficulties for doing business in Montenegro which sends a bad signal to both present and prospective foreign investors. Likewise, the business associations have already recognized the labor regulation in Montenegro as not sufficiently flexible. According to the position of all four business associations, introducing new limitations will not contribute to the promotion of foreign investments in Montenegro.

The aforementioned business associations have expressed their support for the intention of the Government to stimulate domestic labor employment. However, this process should be regulated in a manner which enables and secures continuous operation of companies in Montenegro.

The position document has pointed out following articles that should be amended:

  • Article 64, related to limiting issuance of temporary residence and work permit, and in relation to that:
  • Article 65 and 66, with special emphasis on the discrepancies in terms of employment of the executive director or representative of the company;
  • Article 67, related to time period for issuing temporary residence and work permits;
  • Article 73, paragraph 2, related to distribution of quotas per industries and professions.
  • The solutions proposed in the position document reflect the joint efforts of employers to contribute to the improvement of the business climate in Montenegro.

    Business associations have expressed the hope that the relevant institutions will consider this suggestions as a valuable input of the business sector and incorporate them in future amendments of the Law on Foreigners. In addition, they have confirmed their readiness to provide full technical support in the process of much needed fine-tuning of this Law.
